  1. SINGLE USER SOFTWARE LICENSE AGREEMENT
  2.  
  3. IMPORTANT: READ THIS BEFORE USING YOUR COPY OF 
  4. InDefense's Achilles'Shield.
  5.  
  6. Acceptance.  Use of your copy of Achilles'Shield indicates your acceptance 
  7. of these terms. If you do not agree to these terms and conditions, either 
  8. destroy or return the intact Achilles'Shield package, containing the diskettes, 
  9. together with the other components of the product to the place of purchase.
  10.  
  11. Proprietary Rights.  This program and any accompanying documentation are 
  12. proprietary products of InDefense, Inc. and are protected under international 
  13. copyright laws. Title to the program, or any copy, modification or merged 
  14. portion shall at all times remain with InDefense.
  15.  
  16. Permitted Uses.  You may use the enclosed software on A SINGLE COMPUTER 
  17. that you own or use.  Under no circumstances may you use it on more than one 
  18. machine at a time. You may make a copy of the software for backup purposes, 
  19. provided that you reproduce and place our copyright notice on the backup copy.
  20.  
  21. You may transfer this program and documentation together with this license to 
  22. another party, but only if the other party agrees to accept wholly the terms 
  23. and conditions of this license and you notify InDefense of the name and 
  24. address of the other party.  All copies must be transferred to the same party, 
  25. or you must destroy those copies not transferred.  Any such transfer terminates 
  26. your license.
  27.  
  28. Nonpermitted Uses.  Without the express written consent of InDefense, you may not:
  29.  
  30. 1. Use the software in a computer service business including rental, networking, 
  31.     or timesharing software, nor may you use it for multiple use, networks or on 
  32.     multiple computer system applications in the absence of individual licenses 
  33.     with InDefense.
  34. 2. Use, copy, modify, alter or transfer, electronically or otherwise, the software 
  35.     or documentation except as expressly allowed in this agreement.
  36. 3. Translate, reverse program, de-assemble, decompile or otherwise reverse engineer 
  37.     the software.
  38. 4. Sublicense or lease this program or its documentation.
  39.  
  40. Term.  This license is effective from your date of purchase and shall remain in 
  41. force until terminated.  You may terminate the license and this agreement any 
  42. time by destroying the program and its documentation, together with all copies 
  43. in any form. InDefense may terminate this agreement if you fail to comply with 
  44. any of its terms or conditions. Upon any termination of this license, you agree 
  45. to destroy the licensed software, and its documentation together with all copies, 
  46. modifications or portions of them in any form. You must provide us, on our request, 
  47. written certification of such destruction.
  48.  
  49. Limited Warranty.  InDefense warrants that for a period of ninety (90) days of 
  50. normal use from the date of original purchase, the diskettes on which the 
  51. software is recorded will be free from defects in materials and faulty workmanship.
  52.  
  53. Except for the aforesaid warranty, all products delivered pursuant to this 
  54. Agreement are delivered on an "as is" basis and InDefense, its dealers and 
  55. distributors expressly disclaim any and all other warranties, expressed or 
  56. implied, including, without limitation, implied warranties or conditions of 
  57. merchantable quality or fitness for a particular purpose.
  58.  
  59. Limitation on Liability.  InDefense's entire liability, in tort contract or 
  60. otherwise, and your exclusive remedy for breach of the limited ninety (90) day 
  61. warranty herein before provided for shall be the replacement of any diskette or 
  62. program documentation not meeting with such warranty which is returned to the 
  63. party from whom you purchased, together with a copy of your paid receipt. In no 
  64. event shall InDefense, its dealers or distributors, be liable, in tort contract 
  65. or otherwise, for lost profits, data or information of any kind or for 
  66. consequential, special, indirect, incidental, punitive or other damages that may 
  67. arise through use of the product licensed thereunder. This warranty gives you 
  68. specific legal rights and you may also have other rights under the law of your 
  69. jurisdiction.

  71. Support.  If you have a problem with a defective diskette or CD or with the 
  72. installation or operation of the program, please contact InDefense, Inc. for 
  73. technical support at (831) 471-1413 or support@indefense.com.

  75. U.S. Government Restricted Rights.  The software and documentation are provided 
  76. with restricted rights.  Use, duplication, or disclosure by any the state, local or 
  77. federal government in or of the United States of America is subject to restriction 
  78. as set forth in subparagraph (c)(l)(iii) of The Rights in Technical Data and 
  79. Software-Restricted Rights at 48 CFR 52.227-19, as applicable.

  81. Governing Law.  This license agreement shall be governed by the laws of the state 
  82. of California.
